1.1 The www.fourinthebed,.com.au website ("the website") is owned and operated by L.P and E Danckert Partnership under the A.B.N (45 463 351 045), and trading as "Four in the Bed".

1.2. By accessing or using the Website, you agree to be bound by these terms and conditions ("Terms and Conditions") and acknowledge and accept that you have read and understood all of the Terms and Conditions.

1.3. Whilst Four in the Bed has made every effort to ensure that the information contained in the Website is correct, Four in the Bed cannot accept responsibility for any errors or omissions in the information contained on the Website

1.4. By purchasing a product from this Website you expressly agree to be bound by these Terms and Conditions.

1.5. Four in the Bed may vary these Terms and Conditions from time to time and at any time. Such variation will be effective immediately upon it being published on the Website. You are responsible for keeping yourself informed and up to date with any variation to the Terms and Conditions. You accept that by accessing or using the Website subsequent to any variation to the Terms and Conditions that you agree to be bound by and comply with the Terms and Conditions, as varied

This Website and each part of it (including but not limited to all text, images, product descriptions and other materials) are protected by copyright law. Except where necessary to view the material on the Website, or as permitted by the relevant Copyright Act or other relevant legislation, nothing contained in the Website may be reproduced, copied or re-used, adapted, modified, distributed, uploaded to a third party or linked to without the prior written consent of Four in the Bed. 

The following trademarks displayed on the website are owned and registered by LP and E Danckert Partnership "Four in the Bed".

3. THIRD PARTY WEBSITES

The Website may contain links to other third party websites. Four in the Bed does not endorse or approve any material contained on third party websites. Four in the Bed makes no warranties or representations, express or implied with respect to the appropriateness, cost, quality, accuracy, merchantability or fitness for purpose of material, information, products, services or otherwise referred to on third party websites.

4. COLOURS AND SIZING CHARTS

The colours of our garments may be different to what appears on your monitor. Four in the Bed cannot guarantee that the colour displayed on your monitor is accurate. The Sizing Charts are only intended to act as a guide as to body sizing and are not intended to represent garment dimensions.

5. INDEMNITY AND LIMITATION OF LIABILITY

You hereby agree to indemnify and hold Four in the Bed harmless for any losses, liabilities, damages, claims and expenses suffered or incurred by you arising out of or related to your use of the Website. You agree that Four in the Bed is not liable to you for any losses, liabilities, damages, claims and expenses arising out of or related to your use of the Website.

Four in the Bed does not guarantee that the Website will be free from viruses, spy-ware, worms, trojans ("Viruses") and will not be liable for any loss or damage, whether to personal property or otherwise, suffered as a result of or in connection with any Viruses contained on the Website.

6. PURCHASE OF GOODS

Any order placed by you via this Website constitutes an offer by you to Four in the Bed to purchase a particular product or service for the price (including the delivery and other charges) specified in this Website at the time you place your order.

Four in the Bed reserves the right to accept or reject any offer for any reason, including, without limitation, the unavailability of any product, an error or omission in the price or the product description, or an error in your order.

No binding contract shall be formed unless Four in the Bed communicates to you that it has accepted your order and that payment of the purchase price has been confirmed.

Advertised prices for products or services are quoted in Australian dollars and include Goods and Services Tax (GST). The prices are current at the time they are published on the Website but may change from time to time and at any time at the sole discretion of Four in the Bed.

7. DELIVERY OF GOODS

Delivery within Australia:

Four in the Bed retains right and title to the products you order until you have made payment in full for those products.

Whilst all efforts are made to ensure the safe and timely delivery of products, you agree that Four in the Bed does not bear the risk nor is it liable for loss or damage to the products whilst they are in transit and that the risk of such loss or damage to products passes to you once they are in transit or are in the process of being delivered by the delivery contractor. 

Please allow approximately 7-10 working days for delivery of goods. 

Deliveries are made via Australia Post Esatchel service and Four in the Bed charges flat rate of $10.95 for postage and handling. Four in the Bed posts to all street addresses and post office boxes. To ensure that the order arrives securely, a signature will be required upon delivery. If a signature is not provided, an Australia Post card will be left indicating where to collect the goods from. If for some reason the parcel does not arrive within a reasonable time frame please contact Four in the Bed and it will tracked using the tracking code provided by Australia Post. 

Note: For large orders there may be additional postage fees. If additional fees are payable Four in the Bed will contact you to confirm payment before the order is dispatched. Prices are subject to change. 

International Orders:

International orders will be dispatched via Australia Post Air Mail. Goods will be delivered in approximately 10-15 postal working days depending on the location. Please note that occasionally customs inspections may take place and therefore delay delivery by a few days. Once the goods have arrived into the country of destination, the parcels are distributed by the local postal service.

New Zealand $34.95
Asia/Pacific $45.95
Rest of the World $69.95

Note: For larger orders there may be additional postage fees. It is the responsibility of the purchaser to pay any input duty or sales tax within your own country. We will not charge you Australian goods and services tax. 

To comply with Australian export regulations, we are required to declare the exact value of all items ordered and to mark them as dutiable "merchandise". We are also prohibited by law from marking the order as a "gift", even if order is placed with the intention of sending to a gift recipient. For further information, it may be necessary to call local customs offices to gain further details. 

8. LATE DELIVERIES

If your order has not been delivered within the specified times please contact customerservice@fourinthebed.com.au to obtain your postal reference number. You will need to quote your tax invoice number.

If you are trying to estimate when a package will arrive please consider the following: 

Credit card authorization and address verification must be received prior to processing. 

Orders placed after midday will be downloaded into the system for the following day therefore not processed that day. 

9. PRODUCT DESCRIPTION

Please note that colours may vary slightly from those displayed by your monitor.

10. PAYMENT OPTIONS

Four in the Bed accepts payment via Visa or MasterCard via online merchant SecurePay payment gateway. We accept cheques, bank cheques, money orders and direct deposit to our bank account. For non credit card orders, we will dispatch your order once payment is received and cleared. All prices are in Australian dollars and include GST.

11. APPLICABLE LAW AND JURISDICTION

These Terms and Conditions are governed by and construed in accordance with the laws of the State of New South Wales, Australia.

You and Four in the Bed agree to irrevocably submit to the exclusive jurisdiction of the courts of the State of New South Wales, Australia.
